How you find your dream place in dalyan?
This is where you may need a little help with the guidance from a professional company that cares. Ask your self a few questions. Another thing you may want to consider is whether you want to rent your property out for certain periods of the year, if so then you must look at the local services that are available, maintenance cost and any taxes you may have to pay.
Can I buy property anywhere in Turkey?
As a foreigner you are permitted to buy property almost anywhere in Turkey, provided that the land or property has a valid Tapu (title deed).
There are some restrictions however. You cannot buy land or property that is located near to military sites or other security restricted areas. There are also restrictions regarding land owned by the Turkish Government or Forestry Commission where, it is only possible to obtain property as a leaseholder. There are a lot of gray areas on the latter instance and we would ask that you contact us for more information.
How do I purchase property in dalyan?
Once you have made an offer and the offer is accepted by both of you the vendor will then need to make a contract and pay a deposit of 10%. The contract will usually include the property purchase price, deposit paid, balance outstanding and a completion date. Your contract will be translated in to English for you. We strongly recommend the use of a recommended solicitor for all property purchases.
You will need to supply several photocopies of your passport and at least 12 passport size photographs. You will also need a passport translation from the Notary Public, as well as some paperwork in the Tapu (title deeds office).
The next step is to open a Turkish bank account. The funds placed in this account should be sufficient to cover the purchase cost and any relevant fees. It is worth noting that many banks will not charge a commission for conversion if your money is left for 15 days before conversion to Turkish Lira but be wary of the fluctuating exchange rates one way to be assured of currency conversion problems is to agree a purchase price in Sterling or Euros when making your purchase contract. It is important that all paperwork concerning the transfer of monies in relation to property purchase is kept and recorded should you need to prove that the money was brought in from abroad.
A tax agreement between Turkey and the UK or with some others. has been ratified which prevents double taxation. The professional advice of your lawyer and accountant is strongly recommended.
All of your paper work will be sent to the Military authorities in Izmir for security checks, the main reason for this is to check that the property you are purchasing is not in a security sensitive area. This part of the procedure can take anything between four and twelve weeks so be aware of this when you are giving completion dates in your purchase contract.
Once all the paperwork is returned and validated you can then complete. If you are not using a solicitor this will entail an extremely frustrating and tiring day running around numerous governmental offices dispensing copious amounts of cash and not having the slightest clue as to what is happening. If you are luck all of this will be completed in a day (but don't bank on it). If you are using a solicitor to whom you have given power of attorney then you don't even have to be here for completion. Please note that there are some very strange rules in place at times, make sure that the vendors have moved out and that all of their possessions have gone with them and the house keys are handed over before parting with your cash because, even though you may own the property if the owners wont leave or their possessions are still in the house then you cant move in!
Once successful completion has taken place you must register the purchase with the municipality (Belediye) and arrange for the utilities to be placed in your name.
Another caution... If you buy a property you also buy any debts associated with it so make sure that all utility bills are paid such as water and electricity...
Do I have to buy through an Estate Agent?
Well the answer is no, not really, but Estate Agents here serve the same role as you own local estate agent at home so we don't need to tell you why we exist. We do make sure that all real estate for sale through us is checked for all necessary documentation before it goes on the market. There is nothing more frustrating than to be near completion only to find that the house has no planning permission or there are several names on the deeds and one of them doesn't want to sell. It does happen.
What do Estate Agents Charge?
It is generally accepted that Estate Agents in Turkey charge 3% commission to the vendor and 3% commission to the buyer. That is 6% commission on each property sold.
Building or restoration. Which is best?
If you cannot find a ready built property that suits you, the only other options are to build from new or restore an older property. As to which is better is impossible to say as each case will be unique and dependent on condition of restoration property or location of new building land, plus the rapid inflation of property and land prices further closes the gap between restoration and new build costs.
Some architects are excellent, others are not. Before engaging an architect you are advised to see plenty of his/her previous work in their studio, not just in a portfolio and keep your lawyer close by when drawing up contracts. As your home is created you will be in constant contact with your architect, so it is a good idea to choose someone you can communicate with easily.
Choosing the right plot of land.
If you wish to build a new property you will of course, need land to build on and it would be unfortunate to build your dream home on the wrong plot. When looking at land check where the sun rises and sets to ensure no unwelcome shade or too much sun. Is there a suitable service road, are the utilities such as electricity, water and telephone easily accessible and of course, what percentage can be built on.
Do I need a survey?
Surveys are not usually carried out in Turkey so it is not required, should you want a structural survey they are extremely expensive. We will advise you on the structure of the property and quote you for any building or repair works necessary. There is no fee for this service.
The most important aspect if you are buying land is to ensure that building on that land is permitted and to what percentage. The percentage of the plot that can be built upon is usually between 5% - 30% of the plots size depending on its location. We will always check on the build percentage of land before offering it for sale.
When you decide to sell
Your original investment and any profit after tax can be freely taken out of Turkey. Again, you would be wise to consult your lawyer prior to selling. Property sales in Turkey are not subject to any VAT.

You will then sign "the building construction agreement" with our company. The details of the materials which will be used for your property, will be chosen by yourself and will be indicated in the building construction agreement.
Building construction license must be obtained for all buildings from either the Municipality, the Province, or an authorized private architecture of engineering bureau. In order to obtain the license, application will be made to the above-mentioned authorities by submitting;
Title deed,
Architectural drawings,
Structural drawings,
Electrical and mechanical installation drawings.
If the application is complete, the authorities will grant the permit within at most 30 days.
Your building construction agreement includes;
Geological search of the land upon which we will be building your construction
Lands building construction convenience permission
Architectural drawings,

Electrical and mechanical installation drawings,
Building construction permission from the local municipality,
Labours insurances and accommodation,

The property will be completed in six months time (if the building is within the boundary of a tourism resort, the building construction will have to be started after 1st October and will have to be completed before 1st May)

1) The land cost are to pay beforehand.
2) The owner of construction determine what kind of building he/she wants by explaining its design and style, the exact dimensions in square meter of the building to the civil engineers and architects working for our company. It will take us 2 to 3 weeks to complete the project.
3) A legal written agreement with the customer is signed by clarifying the exact dimensions and project of the building.
4) Cost of the building is found out based on the project and both the firm and the customer come to an agreement on.
5) Cost of building: The customer is expected to pay for the cost of building determined together with the purchaser in four equal installments.
6) 30% of the total price, when we sign the building construction agreement, 30% of the total price, the 2nd month of the building construction started, 30% of the total price, the 4th month of the building construction started, 10% of the total price, on the key delivery of the property to you.(and pay all additional costs for any extra work undertaken.)
The legal agreements regarding with any kind of work which we undertake to do and guarantee are relating to the laws of Turkish Republic .
Who can buy?
All citizens of the countries listed below can legally own a real estate in Turkey due to reciprocity principle and are liable with the same rights as all the Turkish citizens. Presently a new law is pending which may allow this list to open up to other countries in the near future. We will update the list if/when this happens.
Argentina, Australia, Austria, Barbados, Belgium, Brazil, Canada, Colombia, Denmark, Dominican Republic, Egypt, El Salvador, France, Germany, Greece (providing that some restrictions are reserved), Guatemala, Holland, UK, Ireland, Italy, Malawi, Norway, Turkish Republic of Northern Cyprus, Luxembourg, Panama, Russia, Somali,Central African Republic, Chile, Spain, Tanzania, USA, Venezuela, legal immigrants and World Citizens.
That foreigners may purchase land and property in Turkey in their own names provided that properties like Turkish citizens. Except two points;
1-The real properties in the military forbidden regions and safety regions cannot be sold, transferred and rented. As a formal practice the Land Registry Office will be contacting the Army Headquarters for clearance once the application received from the seller for the intention to sell to the foreign buyer. This is part of the Security Investigation process.
2-There is a limit on the total area of the purchase. The foreign natural people cannot acquire more than 30-hectare property in Turkey.
Property Registration and Delivery
Property register in Turkey is not performed by a public notary, but by an official of the Property Registry Department. It is legally compulsory for both sides (the seller and the buyer) to be present at the entry. It is possible to authorise another person to do so but the authorisation requires a notional deed. As a security measure, it is also advisable to authorize the sale through an official notary.
The delivery of the deed of transfer does not require the intervention of a public notary in Turkey. The only applicable stipulation concerning the delivery is that it takes place in writing. After the entry and delivery the property register issues a proof of ownership, which is called 'Tapu'. The ownership is only obtained at the moment that the building(s), if under construction, has been completed and the full amount has been paid.
Mainly there are no legal restrictions against foreigners regarding the acquisition of property ownership. However, the Military Prohibited and Security Areas play an important role; the act regarding Military Prohibited and Security Areas can be an impediment and therefore restrict the acquisition of property by foreigners if the property is located within a particular distance of military sites or strategically important areas. The title deed procedures takes for foreigners 1 to 3 months.
Your Tax Position and visa requirements
A tax agreement between Turkey and the UK or with some others, has been ratified which prevents double taxation. The following are the main taxes and fees that will affect the purchase. There are other taxes that are not part of the initial purchase but will affect the budget afterwards. These include homeowners tax, income tax charged on rental income and inheritance tax.
Transfer tax: Once the sales completed, there is a transfer tax at 3% in total. The tax is based on the declared value of the property. Depending on the agreement, either buyer or seller can pay the amount, but the practice is that both parties equally share.
VAT: Property sales in Turkey are not subject to any VAT.
Notary Public Fees: The scale of the cost is fixed by law and generally range from UK£ 100 to UK£ 250.
Property registry fees: A very small amount is required to pay for the registration (estimated as 50% of the Notary Public fee).
When you decided to sell, your original investment and any profit after tax can be freely taken out of Turkey.
To reside in Turkey for longer than 3 months a Residence Permit is required. These are obtained by formal application to the Police Authorities and Foreigner's Department in the town where you are resident. The procedure is simple, but time consuming. Make sure you have plenty of passport-sized photographs before you start.

Dalyan is situated on a lush river delta in prime farming country where cotton and citrus are the predominate crops. Its placid river meanders by with excellent fishing - it takes its name from the dalyan's, or fish traps, used to capture the migrating fish.
There are some beautiful beaches in the area but by far the best is Iztuzu Beach, also known as Turtle Beach - one of the most important natural nesting grounds in the Mediterranean for the Caretta Caretta (loggerhead sea turtle). No permanent buildings are allowed on this 6 km beach and you'll always find a quiet spot, even in high summer.
You can reach the beach in 20 minutes by road, and there's a regular minibus service. Or you can travel there by boat - a lazy 45-minute cruise through the magnificent reed beds, past ancient Lycian tombs carved into the cliff face.
The ruined city of Kaunos, the stunning expanse of Koycegiz Lake and the health-giving hot springs and mud baths are only a short boat ride away.
Dalyan has every shopping convenience, including a post office, bank, supermarket, carpet and leather shops, and restaurants catering for every taste and price range. And you'll always find a friendly welcome - the population of Dalyan is very diverse and includes many English-speaking people.
Temperatures range from 18 degrees (April and October) to 38 degrees in July. It does rain in winter - that's what makes Dalyan so lush and green - but even January has bright, sunny days.
Dalyan is also one of the easiest places to get to in Turkey. It's only 30 minutes' drive from Dalaman Airport with regular charter flights from the UK during the summer and scheduled flights via Istanbul in winter months.
